Whilst we have made every effort to ensure that the content of this website is as accurate as possible we do not guarantee the content will be free of errors. To the fullest extent permitted at law we shall not be liable for any kind of loss or damage from action taken or reliance placed on information contained on the site.
Any order for goods placed by you, the buyer through our website shall be subject to these terms and conditions. All other terms and conditions express or implied by statute or otherwise are excluded to the fullest extent permitted by law. Nothing in these terms and conditions is intended to limit any rights you might have as a consumer under any applicable law or other statutory rights that may not be excluded. We must receive payment for the total price of the goods that you order before your order can be processed. Once payment has been received by us we will confirm that your order has been received by sending an email to you at the email address you provide in your order form. Order acceptance and the completion of the contract between you and us will take place on the dispatch to you of the goods ordered. If any item you order is not in stock with us or if there is any problem with an order we will try our best to contact you via phone or via email. Please make sure all information you give during the checkout process is as accurate as possible.

All products are covered by a full manufacturers warranty, the period of which varies according to the product. The warranty period starts from the date of purchase and some are conditional on the product being serviced at the recommended intervals by an approved dealer. The warranty covers faults, which may occur due to faulty components or workmanship but excludes consumable items, fair wear and tear or defects caused by misuse.
If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us by email or in writing at our contact address within 7 days. If you notify a problem to us under this condition, our only obligation will be: To make good any shortage or non-delivery; To repair or replace any goods that are damaged or defective; or If repair to or replacement of the goods is not possible, or the cost of repair or replacement is disproportionate in the circumstances, to give you a partial or full refund for the goods in question, depending on what is reasonable in the circumstances. Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage, or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation.
Sims Garden Machinery work in partnership with WorldPay to ensure all information you give us during the order process is encrypted before transmission via the World Wide Web. If any other Internet user should intercept the communication they will only be able to see it in the encrypted form.

The company makes no warranty expressed or implied with respect to accuracy of the information, including price, product editorials or product specifications. The company or its suppliers shall not be liable for incidental, consequential or special damages arising from, or as a result of, any electronic transmission or the accuracy of the information contained herein, even if the company has been advised of the possibility of such damages. Product and manufacturer names are used only for the purpose of identification.
The prices shown are only applicable to purchases made via the Sims Garden Machinery website. Prices in our stores may vary to those shown on the website. Special offers and promotions advertised in the press or other media may be excluded unless specifically advertised as available online. All prices are correct at time of display online and include V.A.T where appropriate. We regret we are not able to offer VAT exclusive pricing for deliveries to the Channel Islands. In the unlikely event of an administrative error resulting in an incorrect price being displayed, we reserve the right to correct the price. In these circumstances, you will not be bound to continue with your purchase, and will be asked to email us to confirm that you wish to proceed.
Cancellation of contract
You may cancel your contract with us for the goods you order at any time up to the end of the seventh working day from the date you receive the ordered goods, which must be in writing or by e-mail. If you have received the goods before you cancel your contract then, you must send the goods back unused and in their original packaging to the address specified by us, at your own cost and risk. If you cancel your contract but we have already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to us at the address specified by us, at your own cost and risk as soon as possible. Once you have notified us that you are cancelling your contract, any sum deducted by us for the products from your credit card, will be re-credited to your account as soon as possible provided that the goods in question are returned by you in the condition they were in when delivered to you. We regret that delivery charges where applicable are non-refundable. If you do not return the goods or pay the cost of return delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.

Cancellation by us
We reserve the right to cancel the contract between us if: We have insufficient stock to deliver the goods you have ordered: The product is no longer available due to manufacturers non supply: We do not deliver to your area; or One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers. If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment.
Robotic Mower Refer a Friend Terms and Conditions
Both parties services must be booked within 12 months of your friends purchase. Your friends robotic mower has to be supplied and installed by us, Sims Garden Machinery. Multiple referrals are encouraged and can be collated. Any further referral discounts will be valid for 12 months from the date of the previous service, i.e refer 3 friends and have 3 years of half price servicing. Offer cannot be combined with any other offers. ‘Saving upto £125’ is off a Gold package service but offer is valid across all robotic mower service packages, savings may vary. Discount only applies to service parts and labour – if any additional repair parts or labour is completed at time of service, this will not be discounted.
